Disabilities and Addictions

Pittsburgh, Pennsylvania, Lawyers Handing Disability and Addiction Claims

Although many people may view an addiction to drugs or alcohol as a disability, the Social Security Administration does not recognize it as such. This means Social Security Disability benefits will not be paid to people whose only impairment is an addiction.

At the Law Offices of Karl E. Osterhout, LLC, in Pittsburgh, our experience tells us many people who suffer from an addiction to drugs or alcohol may unfortunately have additional disabling medical conditions. After more than 20 years of practicing Social Security Disability law, we have handled over 20,000 cases, many of which involved securing SSD benefits for people who suffer from addictions and related disabling conditions.

Addictions and Mental Health

Proving a need for SSD benefits can be tricky when substance abuse is involved, unless someone is clearly physically or mentally limited as a result. Having a history of drug or alcohol addiction will not prevent someone from being found disabled and eligible for benefits. The problem lies in continued or current use of controlled substances, particularly for those afflicted by mental illness. If, in a 30 day period of sobriety, there is documentation of continuing severe mental health problems or physical conditions, it is very possible to make an argument for disability benefits.
